Two frameworks should not be blended together

Identità's family guidance distinguishes Family Reunification under Subsidiary Legislation 217.06 from the separate Family Members Policy. The agency describes the policy as a discretionary framework for certain cases that do not meet all the statutory-route conditions. The existence of both does not mean an applicant can choose the most convenient requirements from each. Establish which complete framework applies to the sponsor and relatives.

Begin with the sponsor's permit, residence history and employment circumstances, then list the family members and their current locations. Those facts are more useful than asking whether Malta generally allows workers to bring family. A person who recently arrived for employment may have a different position from a long-established resident, and a policy exception should not be assumed to cover every newly recruited worker.

Check the residence-history requirement precisely

The current Identità FAQ describes a two-year residence condition for the statutory route and a different general residence-history condition under the policy, with stated exceptions for particular employment categories. Read the live guidance before planning the application. A date calculated from the job offer may differ from the date relevant to lawful residence, so identify which records demonstrate the sponsor's actual history.

Create a timeline showing entry, permission grants, renewals and any periods outside Malta or gaps requiring explanation. Keep the supporting cards and decisions rather than relying only on a current document. If the sponsor changed permission category, ask how that history affects the applicable framework. A correct timeline prevents an application being prepared on the assumption that time in employment and time satisfying the relevant residence condition are necessarily identical.

The relatives’ location can be decisive

Identità's statutory-route guidance states that family members must be outside Malta when the application is made. That is a concrete reason to establish the route before inviting relatives to travel as tourists. A family may understandably want to reunite quickly, but a visit can create a procedural problem if the chosen application requires the relative to remain abroad. Check the conditions for the actual route rather than extrapolating from another family's experience.

Write the intended sequence with the application, approval in principle, any visa step and travel as separate events. Ask what evidence authorises each stage. A commercial adviser booking flights or an employer providing accommodation does not change the official procedure. If circumstances have already changed and the relative is in Malta, obtain advice on the real position instead of submitting forms that describe a location that is no longer accurate.

Income, housing and insurance should cover the household

The agency's guidance includes financial support, suitable accommodation and health coverage among the relevant considerations. Use the current threshold and checklist for the applicable framework. A sponsor's salary should be compared with the household requirement using the method the authority specifies, not merely with a general impression that it is a good salary. Include each family member in the calculation and document the actual income source.

Review accommodation realistically as well as administratively. A worker's initial shared room may not be suitable for the intended family arrangement. Read the lease, occupancy terms and any required attestation instructions before relying on it. For insurance, check the actual coverage and dates for every person. A policy issued for the sponsor alone should not be assumed to extend automatically to a spouse or child.

Relationship evidence needs careful preparation

Prepare civil records for marriage, parentage and any relevant adoption or custody arrangement. Follow the official instructions on authentication and translation. Check that the passport details and names match across records, explaining changes with appropriate evidence. Families with documents from several countries should allow additional preparation time, because one authority may issue a record while another is responsible for its formal validation.

For children, identify the people with parental responsibility and any consent required for relocation. If an adult relative is included in a proposed package, ask whether that person falls within the actual legal category rather than assuming all dependants are treated alike. The family definition is an eligibility question, not something that can be settled by including another name in a quotation.

Plan for the permission after approval

Read the conditions and duration of each family permission and establish the person's work position before making employment commitments. A family document may depend on the sponsor's continuing status and circumstances. Keep renewals, employer changes and family changes in one calendar, while preserving a separate record for each person. If the sponsor's permission is at risk or the relationship changes, obtain timely advice on the actual circumstances.
