Identify the work relationship precisely

Malta's Nomad Residence Permit is designed around qualifying remote work connected with foreign employers, companies, or clients. Residency Malta's current questions distinguish employment, self-employment through a foreign company, and freelance services. Begin by identifying which relationship actually describes your work. A person who owns a company and invoices through it should not automatically use the same evidence as an employee simply because both receive regular payments into a personal bank account.

The agency also excludes services to Malta-based businesses or individuals under this permit, including relevant indirect arrangements. Check the current eligibility conditions, nationality restrictions, and income rules before preparing a file. This guide concentrates on the evidence of work; it is not an individual eligibility decision or tax assessment. The remote-work description must fit the real commercial arrangement, including who receives the service and where the relevant business is established.

Explain what can be done remotely

For an employee, the contract and employer confirmation should make the duties and remote arrangement understandable. The official checklist asks for evidence that the work can be performed independently of location. A general office policy may not clearly establish permission for the particular employee to work from Malta. Clarify the arrangement with the employer, including any limitations that affect the proposed period. Do not present a short informal exception as an indefinite authorisation.

Describe duties in language a reader outside the business can follow. A title such as consultant or director may cover many different activities. Explain the relevant outputs and working relationship without adding unnecessary confidential commercial information. If the employer has a Maltese subsidiary or clients, examine whether the actual assignment falls within the agency's exclusions. The place where salary is paid does not alone answer who benefits from the work performed.

Connect company ownership with personal income

Applicants relying on their own foreign company need to show the relevant corporate relationship and the income received from that activity. The official checklist identifies incorporation and shareholding evidence. Organise the records so that the company named in the application can be connected with the applicant and the payments. A business bank balance is not automatically the applicant's personal income, and company turnover does not necessarily equal the amount available to support the household.

Where the business uses a trading name, explain its connection to the legal entity. If payments pass through a processor or arrive under a shortened description, retain records that make them traceable. Do not manufacture an employment contract with your own business merely to imitate another category's checklist. Present the actual structure and ask the agency or a qualified adviser how the required evidence should be supplied when the jurisdiction uses different corporate document names.

Give freelance contracts a complete picture

A freelancer's file should connect the services, clients, agreed compensation, and payments received. The checklist calls for contracts describing duties and payment rates, supported by income records. If several clients provide the qualifying work, organise them in a clear index. Explain contract periods and any renewal provisions accurately. An expired engagement should not be presented as continuing merely because the client may offer more work in the future.

Distinguish guaranteed or contracted work from a pipeline of prospective clients. Residency Malta's current guidance includes a forward-looking income requirement, so past success alone may not answer the question. Review the current threshold and period directly on the official site. If a contract can be terminated or depends on milestones, understand those provisions and present the document as issued. The application should describe the commercial security actually available, not a more certain version invented for the visa file.

Follow the sequence after submission

The agency's checklist separates initial work and identity evidence from documents requested after approval in principle, including accommodation and comprehensive health insurance. Follow the actual instructions attached to your case. A travel insurance policy should not be assumed to replace the health cover requested for the residence permit. Before committing to accommodation, read the agency's requirements and ensure that the property evidence will cover the relevant permit period.

Submission itself does not extend lawful stay in Malta, as the checklist expressly warns. Keep your current immigration deadline separate from the processing of the Nomad application. An acknowledgement or receipt establishes that something was submitted, not every right needed while waiting. If applying from or travelling through Malta, verify the lawful position before relying on the pending file. This is especially important when accommodation commitments begin before the residence process is complete.

Plan for changes and renewal evidence

Keep contracts, income records, and communications in an organised file throughout the permission period. A new employer, changed client base, or local business opportunity can affect the facts on which the application was assessed. Consult the agency's current notification and renewal instructions before acting on a material change. The permit should not be treated as unrestricted access to every type of employment simply because the holder is already resident.

Tax obligations require their own assessment; immigration permission is not a complete tax ruling. Malta's tax authority publishes specific Nomad rules and guidance, and renewal instructions may request related evidence. Take advice based on the actual income and residence pattern where needed. The strongest application begins with an honest account of the foreign work and maintains that clarity later, allowing contracts, payment records, and the holder's activities to remain consistent with the permission granted.
